CUA Pools Remote Service – Terms of Service

Welcome to CUA Pools! By subscribing to our Remote Residential Pool Service, you agree to the following Terms of Service. Please read them carefully.

1. Service Overview

CUA Pools provides an automated pool chemical maintenance service using a smart chemical feeder that doses chlorine and monitors your pool's filter pressure. This service includes all required chemicals, shipped directly to you, to maintain a properly balanced pool.

2. Subscription Plans & Billing

2.1 Subscription Terms

  • We offer 3-month, 6-month, and 12-month prepaid plans.
  • The 12-month plan includes a waived setup fee; otherwise, a one-time $150 setup fee applies.
  • Subscriptions automatically renew unless canceled before the renewal date.

2.2 Payment & Auto-Renewal

  • Payments are charged upfront for the selected subscription period
  • By subscribing, you authorize automatic billing to your payment method.
  • Subscription renewals will be billed automatically unless you cancel before your renewal date.

2.3 Refunds & Cancellations

  • We offer no refunds once chemicals have shipped.
  • You may cancel before your renewal date to avoid being charged for the next period.
  • If you cancel and later restart your service, the setup fee may apply again unless your service remained uninterrupted.

3. Service Eligibility & Requirements

3.1 Homeowner Responsibilities

  • You must provide a working power outlet for the smart chemical feeder.
  • Monthly water testing is required using provided test strips to maintain balance.
  • Proper pool circulation is necessary for effective chlorine distribution.

3.2 Compatibility with Saltwater Pools

  • Our service works with saltwater pools, but we recommend disabling the salt system to prevent pH spikes.
  • Using CUA Pools eliminates the need for salt cell replacements and salt level maintenance.

4. Equipment Ownership & Maintenance

4.1 Smart Chemical Feeder

  • The smart chemical feeder is provided as part of your service.
  • The device remains the property of CUA Pools and must be returned if the service is canceled.
  • If lost or damaged due to improper use, a replacement fee may apply.

4.2 Equipment Warranty & Support

  • We provide technical support for any malfunctions or setup issues.
  • The feeder is covered under a limited warranty for defects, but damage from improper use is not covered.

5. Shipping & Chemical Supply

  • All necessary chemicals are included and shipped directly to your home.
  • Orders are processed within 5 business days and delivered within 10 days.
  • It is your responsibility to store chemicals safely and securely.

6. Service Monitoring & Alerts

  • Our system monitors your filter pressure and will alert you if:
  • Filter pressure is too high or too low.
  • We do not monitor real-time water chemistry beyond the homeowner's monthly test results.

7. Limitation of Liability

  • CUA Pools is not responsible for:
  • Pool damage due to neglect, improper testing, or failure to follow recommendations.
  • Any issues related to improper pool circulation or equipment malfunctions outside of our system.
  • Chemical imbalances caused by external factors (e.g., excessive rain, bather load, or pool leaks).
  • Under no circumstances will CUA Pools be liable for direct, indirect, incidental, or consequential damages related to service use.

8. Cancellation & Equipment Return Policy

  • If you cancel your service, you must return the smart chemical feeder within 30 days.
  • If the equipment is not returned, a replacement fee of $850 will be charged.

9. Modifications to Terms & Service

  • CUA Pools may update these Terms of Service at any time.
  • Continued use of our service constitutes agreement to any updates.
